Staying in Office to seek tenure elongation or determination is an Illegality and unknown to the Constitution – Osun Government

No elected official can stay in office beyond his or tenure while seeking tenure elongation or determination and any such assertion is an affront on the constitution and a mockery of our democracy.

State Commissioner for Information, Kolapo Alimi Esq made the above assertion in Osogbo today, condemning as ‘a rape of democracy’, a statement credited to the Osun state All Progressive Congress (APC) and the tenure – expired, court – sacked chairmen that they will stay in office until the Supreme Court determine their tenure elongation/determination case.

The Commissioner who said the state APC by its declaration has declared war on democratic practices and rule of law, berated the open declaration of impunity and said it shocked the legal and pro- democracy communities, leading to an awakening of the public to despotic trends and brute force as weapons on our democracy.

“We assert unequivocally that the self awarded tenure of court sacked chairmen lapsed on October 22, 2025 and they must vacate office while they pursue their bid to elongate their illegal tenure. There is nowhere in our laws or the constitution where you stay put in office to extend tenure.

“The Supreme Court judgement on the subject subsists. Moreover, the Attorney General of the Federation deposed to an affidavit at the Supreme Court affirming that the tenure of these illegal chairmen lapsed by October, 2025. That is the position of the law”, the Commissioner posited.

Hon Alimi pressed further that being a relation of the president is not and cannot be a basis to violate the law, breach the constitution and impose rule of force, commending the pro- democracy movement for wading into the matter.

“We note the rising awareness and involvement of the pro-democracy societies. We must protect our democracy from agents of impunity. What is happening in Osun is a rape of democracy that should worry all lovers of democracy and men of goodwill locally and internally “, the Commissioner concluded.
